Orders
An agreement between we (dearplants.com) and you (the customer) is made on these terms when we accept an order placed by you via our Web Site.
The description of the product, the price and delivery costs are set in the order page. We will confirm the reception of the order on-screen and will be confirmed by an email sent to you.
The quantity, quality and description of the products will be those set in your order (if accepted by us).
Orders are accepted at our sole discretion but are normally accepted if the products are available, the order reflects current pricing, you’re shipping address is within our delivery areas (see Shipping and Delivery page for details), the cost reflects current pricing to the destination and the payment is successfully completed.
We give our best to describe the products available the best way.
However, because of the nature of the products there are inevitably slight variations in size, shape and colour between different specimens.
Product pictures, descriptions and other information are approximate and for guidance only.
Prices
Prices are visible in the shop and product details pages and also in the cart and order pages. The prices are subject to change.
Our charges for shipping are detailed on the order page and will be included in the total price for the products. More details about shipping fees and delivery are detailed in Shipping and delivery page.
Promotions
Discount codes (including those offered/displayed by third parties) will be confirmed during payment check against any abuse. Any abusive use the promotion codes will lead to order cancellation.
Products availability
At any given time we try our best to have accurate product stock availability on website. However, if we receive orders that exceed the available quantity we will prioritize in a “first in first out” priority and may have to cancel the excess orders.
Payment
We accept Paypal payments to make it more easy and secure to our customers. We do not store or have access to any bank information about our customers. Paypal handles it all. If it is not possible to obtain full payment for the products, we can cancel the order or suspend any further deliveries to you. This does not affect any other rights we may have.

Risk of damage or loss
Risk of damage or loss of the products passes to you at the time of delivery to you. A photo proof of dispatch will be made available if you select the “Standard” delivery option. A tracking number is provided when “Tracked” postage is selected.
Ownership
You will only own the products once we have received cleared payment in full and the products have been delivered to you.
Returns
We accept returns within 14 days from buying date. The buyer is responsible for return postage costs. Contact us for details.

Warranties
We aim to provide high quality products to our customers. Plants are healthy and disease free. Seeds are collected from high quality plants, they are reliable, dried and stored in cold environment to preserve the germination capacity.
We provide several guides on how to plant and sow the products that we sell (see links below) but as you can understand we cannot guarantee plants that customers let dry by the sun or wind, plant in inappropriate conditions or seeds not properly sown. We cannot also guarantee that all the seeds will germinate, that will be unfair and dishonest from us as these are natural products and several conditions are out of our control.

Liability
If you have a valid claim in respect of any of the products which is based on any defect in their quality or condition or their failure to meet specification in accordance with these conditions, and you have returned the products within a reasonable time, you will be entitled to choose either a refund of the price of the products or replacement free of charge.
We shall not be liable to you in connection with any contract, in tort (including negligence), contract or otherwise for any loss of profit, anticipated savings or data that your business may suffer.
We will continually improve our catalog so changes to the products may occur at any time. We will use our efforts to keep the Web Site up to date but the information and specifications given are for your information only and are subject to change without notice. Pictures on the Web Site are generally accurate but variations in colour, shape and size must be expected.

We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.
